Acquisition of Turkish Citizenship by Purchasing A Real Estate Property

Acquisition of Turkish citizenship through the purchase of real estate is regulated as one of the exceptional cases in the acquisition of Turkish citizenship within the scope of Article 12 of the Turkish Citizenship Law No. 5901. Under this article, in accordance with subparagraph (j) of the first paragraph of Article 31 of the Law No. 6458 on Foreigners and International Protection ("Law No. 6458"), foreigners who do not work in Turkey can acquire Turkish citizenship with the decision of the President as per the Regulation on the Implementation of the Turkish Citizenship Law (“Regulations”) Article 20.In addition, under the relevant paragraph of Article 31 of the Law No. 6458, the foreign spouse and foreign children of the investors  can exceptionally acquire citizenship. 

Pursuant to subparagraph (b) of the second paragraph of Article 20 of the Regulation, foreigners can acquire Turkish citizenship: 

  • Through the purchase of real estate with a minimum amount of USD 250.000 or its equivalent in foreign currency or Turkish Lira, provided that it is not sold within three years, or 
  • Through the establishment of a Condominium ownership or condominium servitude, the contract regarding the immovable property, for which at least 250,000 USD or equivalent foreign currency or the equivalent amount in Turkish Lira has been deposited in advance, with the preparation of a preliminary contract for real estate sale at a notary, provided that it is not transferred or cancelled within three years. 

In order to determine whether the real estate is worth USD 250,000, a Real Estate Appraisal Report must be obtained from a valuation firm that has been granted the Real Estate Appraisal Authority by the Capital Markets Board. The validity period of the Real Estate Appraisal Report is three months from the date of issuance and the value shown in the report should be at least 250,000 USD. Following the reception of the Real Estate Appraisal Report, the original receipt that shows the money transfer and other necessary documents are taken to the Land Registry Directorate and the real estate transfer is carried out through the annotation of the three year promise to not sell the property. 

The documents are then sent to the authority that will issue the certificate of conformity by the Land Registry Office, after the transactions are completed with a three-year commitment not to sell the real estate. Following the receipt of the Certificate of Conformity, citizenship residency application is made to the Provincial Directorate of Immigration Administration together with the documents required to apply for a residence permit. After the residence permit application is obtained, an application for citizenship is made to the Provincial Directorate of Population and Citizenship Affairs. The citizenship application is examined by the special office of foreign investors established by the Ministry of Internal Affairs. 

After all approvals from the relevant institutions are received, the application will be concluded with the Presidential decision.
